Mr Roadworthy Pty Ltd – Website Terms and Conditions of Use
Mr Roadworthy Pty Ltd is a provider of vehicle inspection services. By accessing or using the Mr Roadworthy Pty Ltd website made available at www.mrroadworthy.com.au (Mr Roadworthy Website), you agree to be bound by the following terms and conditions of use (and the other terms and conditions and policies referred to in these terms and conditions) as amended from time to time.
The terms and conditions governing your use of Mr Roadworthy services, such as vehicle inspection services, are set out in the Mr Roadworthy – Inspection Service Terms.
RESTRICTIONS ON USE OF MR ROADWORTHY Pty Ltd WEBSITE
- Except for the Material held in your computer’s cache or a single permanent copy of the Material for your personal use you must not without the prior written approval of Mr Roadworthy Pty Ltd:
- modify, copy, distribute, transmit, display, perform, reproduce, publish or license any Material;
- use or attempt to use any Material published on the Mr Roadworthy Website to create any web site or publication or searchable database;
- mirror or frame any web site or page within the Mr Roadworthy Website;
- use any automated process of any sort to query, access, retrieve, scrape, data-mine or copy any Material on the Mr Roadworthy Website or generate or compile any document, index or database based on the Material published on the Mr Roadworthy Website;
- transfer or sell any information, functionality or products or services offered on the Mr Roadworthy Website; or
- undertake any other action which is in violation of these terms and conditions (or other terms and conditions and policies referred to in these terms and conditions) or any applicable law.
- If Mr Roadworthy Pty Ltd Inspect considers, in its absolute discretion, that you or any party related to you (including any agent, representative, contractor or associate) has acted contrary to these Terms and Conditions or in a manner contrary to Mr Roadworthy interests, then Mr Roadworthy may immediately terminate your right to access and use the Mr Roadworthy Website at any time and reserves its rights to take any action it deems necessary or desirable to prevent such repeated action and / or further access to the Mr Roadworthy Website.
VEHICLE INSPECTION
- The vehicle inspection is VISUAL non-intrusive and non-mechanical only and Mr Roadworthy Inspectors will not be responsible for any defects that are latent discovered which were not visually apparent during the inspection. The vehicle inspection will cover the vehicle’s exterior, interior, engine compartment, tyres and wheels, brakes and a road test where possible. Mr Roadworthy is not liable for any present or hidden iron oxide on vehicles frame(chassis). The vehicle inspection will specifically not cover the items set out below. No removal of parts or components is undertaken during the inspection process. You acknowledge that while Mr Roadworthy Inspectors use accepted methods for fault detection, these methods will not necessarily identify all faults with a vehicle. You should consider the age and condition of the vehicle at the time of inspection and any Report should be reviewed in this context. Vehicles are only road tested to speed limit of local area.
- The Report provided by Mr Roadworthy to you is only current as at the time it is issued. It is a buyer’s responsibility to conduct a visual inspection of the vehicle at the point of sale as Mr Roadworthy can only advise on the condition of the vehicle at the time of inspection. You acknowledge that Mr Roadworthy does not check for any manufacturer recall notices and you should check that the vehicle is not subject to a recall notice.
- Mr Roadworthy will not be responsible for the terms of any transaction between any persons in relation to any vehicle inspected by Mr Roadworthy Inspector for resolving any dispute between any persons regarding any transaction.
- Subject to all applicable laws Mr Roadworthy does not provide any guarantee, warranty or representation regarding the nature, reliability, accuracy or completeness of any information contained in the Report or the fitness of the information contained in the Report for any purpose intended by you. To the full extent permitted by the law, Mr Roadworthy will only be liable to you: (i) pursuant to any guarantee, right or contractual term that arises, is created or is implied by operation of law and that cannot be excluded PROVIDED THAT to the full extent permitted by law, any such liability of Mr Roadworthy is limited, at Mr Roadworthy option, to (A) replacing or repairing the relevant goods (B) supplying goods equivalent to the relevant goods (C) supplying the relevant services again; or (D) paying the cost of such replacement, repairs or supply, subject always to subclause (g) below; or (ii) if Your claim arises from or in connection with any deliberate breach of these terms and conditions or fraud by Mr Roadworthy.
- Except to the extent that liability cannot be excluded, Mr Roadworthy, will not be liable to you for claims arising out of or in connection with your access and use of the this Report whether arising in contract, tort (including negligence), indemnity, strict liability, breach of warranty or statute.
- To the full extent permitted by law, Mr Roadworthy will not be liable to you for loss of use, production, profit, revenue, business, data, contractor anticipated savings or for delay or for any financing costs or increase in operating costs or any economic loss for any indirect or consequential loss or damage.
- Your use of this Inspection Report is subject to the Mr Roadworthy Service Terms available at www.mrroadworthy.com.au
- It is the purchaser’s responsibility to re-check the inspected vehicle personally before settlement.
- All purchasers are to check with the relevant authorities Australia wide for any type of Write-Off history prior to purchase.
MR ROADWORTHY DOES NOT CHECK THE FOLLOWING ITEMS:
- Brake function and lining material, brake drums, limited to what is immediately visible
- Technical systems
- Evidence of brake fluid contamination
- Odometer and camshaft belt, drive belt and timing belt
- Anti-lock braking system (ABS) mechanics
- Estimated expiry of exhaust system, clutch, dual mass flywheels
- Meters indicating oil and fuel consumption or the degree of oil and fuel consumption
- Functionality of audio-visual or entertainment system including CD, Cassette, TV, DVD, iPod connectivity, sensors, alarm/security devices, satellite navigation systems/GPS
- Reason for oil leaks
- Degree of gas emissions
- Oil pump strainer to assess sludge build up
- Catalytic converters
- Wheel cylinders
- Additional accessories included as a result of owner’s modifications
- Standard to which repairs or service history have been completed
- Mechanical switching of wipers and lights
- Engine cylinder compression
- LPG systems
- Air conditioning efficiency
- Vehicle electrics and electronics
- Transmission mechanics
- Water pump/fan
- Body water leaks or reason for leaks
- Status of habitation areas of motorhomes or caravans
- Vehicle’s computer systems, such as trip meter computers, cruise control and any other computer systems
THE REPORT IS NOT A SAFETY CERTIFICATE/ROADWORTHY CERTIFICATE AND CANNOT BE USED AS A SAFETY CERTIFICATE/ ROADWORTHY CERTIFICATE.
