Terms and Conditions
1. General
These Terms and Conditions may be updated by Mr Roadworthy Pty Ltd from time to time. We recommend that you review these Terms and Conditions in full whenever you book a Vehicle Inspection with Mr Roadworthy Pty Ltd, as changes may have occurred. By booking a Vehicle Inspection, you agree to be bound by the Terms and Conditions in effect at the time of your booking.
In these Terms and Conditions, any reference to Mr Roadworthy Pty Ltd includes its contractors and employees.
Safety Certificates & Pre Purchase Inspection
Your Vehicle Inspection Report reflects the condition of the vehicle at the time of the inspection.
Scope of Inspection
Our Mobile Vehicle Inspection includes an assessment of the vehicle’s exterior, interior, engine compartment, drivetrain, tyres and wheels, some brake components, and underbody. If the vehicle is registered and roadworthy, it will also include a road test. Mechanical checks focus on the engine compartment, drivetrain, some brake components, and underbody.
The inspection is based on an external evaluation of components. Due to time and cost constraints, we do not dismantle assemblies to inspect internal parts. These components are evaluated through noise, operation, and performance during the road test. For detailed inspections of internal parts, you will need to contact a specialised service provider, as we do not offer this service.
Limitations and Exclusions
There are vehicles we may not be able to inspect or for which only a limited inspection can be conducted. This may be due to limited access, complexity, or the need for specialised tools. We will inform you of such limitations prior to the inspection, and this will be noted in the Vehicle Inspection Report. If we are unable to proceed with the inspection, or if you cancel due to these limitations, we will refund your fee.
Road tests are conducted within the permissible speed limits of the test area. Certain faults, such as wheel bearing vibrations or performance issues, may not be detectable without higher-speed testing.
For accurate paint and body assessments, the vehicle must be clean and free from water, dust, and mud. Scratches or paint chips will only be noted if deemed excessive by the inspector.
The Vehicle Inspection Report
The inspection checklist covers agreed items at the time of booking. The report identifies defects visible during the inspection or reasonably capable of being detected through external visual examination. We cannot report defects that are not evident during the inspection.
The report provides an opinion on the vehicle’s overall condition, based on the inspector’s expertise and experience, to assist in your decision-making. This opinion is subjective and not a recommendation to purchase or not purchase the vehicle. Such decisions are solely the responsibility of the prospective buyer, who should consider all relevant factors.
Exclusions
The Vehicle Inspection Report will not identify hidden or concealed defects, latent or intermittent issues not apparent at the time of inspection, or problems that cannot be detected without dismantling parts of the vehicle. Additionally, the report will not address defects that manifest after the inspection. The following items are not checked as part of the inspection:
- Mechanical and Operational Checks:
- Oil and fuel consumption
- Source of oil leaks
- Oil pump strainer for sludge build-up
- Engine cylinder compression
- Vehicle electrics and electronics requiring specific diagnostic equipment
- Timing belts/cam belts
- Advanced driver assistance systems, electronic driving aids, radars, and sensors
- Alarm systems or anti-theft devices
- Electric motors or electric propulsion systems
- Hybrid or electric vehicle charging equipment
- Auxiliary, hybrid, or electric vehicle batteries and power systems
- Operation of in-car entertainment, media, and satellite navigation systems
- Exhaust emissions using gas analysis equipment
- Air conditioning efficiency testing
- Vehicle odometer accuracy
- Quality of previous repairs or replacements
- Physical Components:
- Bodywork water leaks or their sources
- Brake pads, linings, and contact surfaces (for mobile inspections)
- Brake components not visible without removing or dismantling covers or parts
- Wheel alignment and dual-wheel axle systems requiring wheel removal
- Tyre pressures, tyre pressure monitoring systems, and tyre age
- Bearings of any type
- Locking differentials (diff locks)
- Roof heights exceeding 2.4 meters
- Non-standard or aftermarket accessories or personal modifications
- Operational Limitations:
- 4×4 vehicles with dual-range transfer cases and/or center locking differentials are checked for engagement only. Proper testing requires unsealed surfaces and varying conditions, which are beyond the scope of this inspection.
- The inspection may not assess the engine across its full operating temperature range. Issues that manifest only when the engine is cold may not be detected if the engine is already at full operating temperature.
- Road tests are conducted only within the immediate permissible test area and may not detect issues evident at higher speeds.
- Documentation:
- Service records, owner’s manuals, damage reports, and repair records accompanying the vehicle are not reviewed or verified for accuracy.
- Other Exclusions:
- Fixed items such as baby seats, seat covers, steering wheel covers, dash mats, or other coverings are not removed during the inspection.
- Any manufacturer recalls or aftermarket modifications affecting the vehicle are not reviewed or assessed.
This visual inspection is conducted without dismantling or interfering with vehicle components and focuses solely on external checks of the vehicle. For more comprehensive or diagnostic evaluations, we recommend consulting a specialized service provider
Risk to Purchaser
Due to limitations in detecting certain faults—such as those that are internal, concealed, hidden, or not audible during the road test—purchasing a vehicle without a warranty from the seller may expose the purchaser to significant risks.
Some vehicles, particularly older ones, may have serious internal, structural, or mechanical defects, as well as hidden rust corrosion. While every effort is made to identify potential issues, it is important to acknowledge that such defects may not be detectable through an external visual assessment. Older vehicles may also be less reliable and require more frequent repairs or servicing compared to newer models. These and other potential disadvantages of owning an older vehicle should be carefully considered and accepted by the purchaser.
Please note that an inspection assesses the condition of the vehicle only at the time of the inspection. Defects may develop after the inspection that were not identifiable during the process.
Fees and Cancellations
All fees and charges for the Vehicle Inspection must be paid at the time of booking using a major credit card.
We reserve the right to refuse to inspect or report on any vehicle. If this occurs, all fees and charges paid will be refunded in full—except in cases where our inspector arrives at the vehicle location and deems it unsafe to proceed with the inspection due to the location or the condition of the vehicle. In such cases, a $100 attendance fee will apply, and the remaining balance of the fees and charges will be refunded.
If you cancel your Vehicle Inspection with more than 24 hours’ notice, you will receive a full refund.
If you cancel with less than 24 hours’ notice and we are unable to fill the booking with another customer, or if our inspector has already attended the vehicle location, a $100 cancellation/attendance fee will apply, and the remaining balance of the fees and charges will be refunded.
Booking Times and Delays
Mr Roadworthy Pty Ltd will not be held liable for delays or failure to perform a Vehicle Inspection if such delays or failures result from events or circumstances beyond our reasonable control.
Timeframes may change at short notice due to location and availability. We will make every reasonable effort to contact you and notify you of any changes. If we are unable to reach you, we will attempt to contact the seller or the person at the inspection location to arrange a suitable time.
If no mutually agreeable time frame can be established in these circumstances, we will refund the fees and charges paid by you.
Complaints
If you have a complaint or are dissatisfied with our service, please contact Mr Roadworthy Pty Ltd at P: 0477 005 922. Your complaint will be referred to our Member Relations team for resolution.
We may need to re-inspect the vehicle to address the complaint, and we request that no repairs be performed on the vehicle before this re-inspection.
Statutory Warranty
Our services come with guarantees under Australian Consumer Law that cannot be excluded.
For major failures, you are entitled to:
- Cancel your service contract with us; and
- Receive a refund for the unused portion of the service, or compensation for its reduced value.
For issues that do not constitute a major failure, we will rectify the problem within a reasonable timeframe. If we fail to do so, you may cancel your contract and receive a refund for the unused portion of the service.
Liability
Certain State and Commonwealth legislation, including the Competition and Consumer Act 2010 (Cth), imply warranties and conditions or impose obligations that cannot be excluded, restricted, or modified. These Terms and Conditions do not attempt to exclude any statutory rights available to you that cannot be excluded, and must always be read subject to those statutory provisions.
Except for statutory provisions that cannot be excluded, we disclaim all conditions and warranties that may be implied by law.
To the maximum extent permitted by law, our liability for breach of any non-excludable implied warranty or condition is limited, at our discretion, to:
- The re-supply of services provided by us, or
- The cost of having those services re-supplied.
Neither party shall be liable for any demurrage, loss of use, anticipated profits, or special, indirect, or consequential damages.
To the extent permitted by law, you agree that Mr Roadworthy Pty Ltd’s maximum liability to you (whether in contract, tort, including negligence, or statute) is limited to the fees paid by you for the services provided, except in the following circumstances:
- Damage to the Vehicle: If damage to the vehicle occurs and is caused or contributed to by Mr Roadworthy Pty Ltd’s negligence or unlawful act.
- Gross Negligence in Inspection: If Mr Roadworthy Pty Ltd’s gross negligence in conducting the inspection results in a defect being undetected, and you purchase the vehicle as a result, our liability will be limited to the lesser of:
- The cost of repairing the undetected defect; or
- The price you paid for the vehicle.
Privacy
Mr Roadworthy Pty Ltd collects, holds, and discloses your personal information (e.g., name, address, email address, and vehicle details) in accordance with our Privacy Policy.

Vehicle Registration
It is your responsibility to ensure that both your vehicle and the seller’s vehicle are legally registered in compliance with Queensland’s legislative and regulatory requirements. Driving an unregistered vehicle is illegal, and you must notify us in advance if the vehicle is unregistered.
If you fail to notify us of your vehicle’s unregistered status, you agree to indemnify Mr Roadworthy Pty Ltd for any fines, penalties, loss, damage, injury, or death caused to any person or property while we are driving or otherwise operating your unregistered vehicle.
These terms and conditions apply to all vehicles, including motorbikes, trucks, and all types of trailers.
